Affirmative (“we”, “our” and “us”)  is the trading name of Affirmative Finance Limited, Ascent Funding Limited, Constructive Lending Limited, Sprint Loans Limited and UK Mortgage Corporation Limited.

Information will be shared between these companies where there is a legitimate interest to do so.

So that we can provide our products, services and contracts to you we need to process your information and the information of other connected parties where relevant, e.g. spouse, directors (corporate lending), next of kin (in case of emergency), business contacts etc. This may include collecting, storing, recording, using and deleting information.

We will only collect information that is relevant and that we need or are required to collect.

How do you collect personal information?

We collect your information where you (or someone on your behalf) submit forms to us, make an enquiry on our website or correspond with us by telephone or email.

If you provide us with information about other people, for example, joint applications, tenants (for lending) or references (for employment), you must have the permission of the other person to provide their information to us.

We may also receive information from third parties, for example, where you have been introduced to us by another company or from credit reference agencies.

How do you use personal information?

We will use your information where we have a legal or regulatory obligation, to fulfil or enter into a contract with you, to protect your vital interests, for our legitimate interests (where this does not affect your rights and is explained further in the privacy notice) and/ or where we have your consent.

We will use the information to provide you with a loan, employment contract or to conduct a business relationship with you.

Where you have given us specific permission and we send you information about our products and services you can tell us to stop at any time.

If you have given us permission to process sensitive information about you, such as medical information or relating to any offences or convictions you may ask us to stop processing this information, but we may not be able to provide you with a loan or employment contract.

How long do you keep personal information?

We will keep a record of your personal information, normally for six years starting from the date the account has closed or where the relationship ends. This is to ensure that we provide the best possible product or service and where we are required to keep your personal information to meet our legal and regulatory obligations.

If an application has been unsuccessful we will normally keep your information for 12 months. This is for our legitimate interests.

We will keep a record of telephone calls for normally six years from the date the call was made.

After this time, we will delete the information or save it in a way that you cannot be identified from it.

Who do you share personal information with?

We will share your information with our suppliers or business partners in order to provide the product, service or contract to you. Where we do this, we endeavour to have appropriate contracts or agreements in place to ensure that they also protect your information.

We may also share information with external parties for reasons including but not limited to the following: satisfying our legal or regulatory obligations (e.g. regulators, auditors); for the prevention of crime (e.g. police, National Crime Agency, credit reference agencies); and to recover any debt if any contractual obligations are breached by you.

We do not sell or rent your data to anyone.

What are my rights?

You have the right of access to your information, the right to have inaccurate information corrected, the right to erase information (to be forgotten), the right to object to or restrict our processing of your information.
